New York General Business Law section 770 defines home improvement to include repairing, remodeling, altering or adding to residential property, and names roofing among the covered work. A home improvement contract falls under Article 36-A where the aggregate contract price specified in one or more home improvement contracts exceeds five hundred dollars.

New York General Business Law section 771-b, headed Responsibilities of roofing contractors, opens with subdivision 1 requiring that every roofing contractor enter into a written contract with an owner, and that the contract contain the name of the insurer, the type of insurance coverage required by subdivision nine, and the insurance policy limits.

Section R905.1.2 of the Residential Code of New York State requires that in areas with a history of ice forming along the eaves causing a backup of water, an ice barrier be installed for asphalt shingles, metal roof shingles, mineral-surfaced roll roofing, slate and slate-type shingles, wood shingles and wood shakes. It must be not fewer than two layers of underlayment cemented together, or a self-adhering polymer-modified bitumen sheet, used in place of normal underlayment, and it must extend from the lowest edge of all roof surfaces to a point not less than 24 inches inside the exterior wall line of the building.

Deciding

When to call a roofer, and when not to

The honest version. Three of these mean pick up the phone. Three of them usually do not, or not yet.

  • The roof already carries two layers and it is leaking. A third covering is not a lawful option under section R908. The only compliant answer is a tear-off, so price that rather than a patch on borrowed time.
  • Water comes in at the eaves or the ceiling stains every February. That is an ice dam, and it is a heat and ventilation problem. A new covering over a blocked soffit will dam again the first winter.
  • Wind lifted or stripped shingles, or a limb came down on the roof. Get it weathertight and documented while it is fresh, then decide without pressure whether it is a repair, one slope or the whole roof.
  • One valley, one vent boot or one flashing is leaking. That is a repair, not a roof. Anyone quoting a full replacement off a single stain has not diagnosed anything yet.
  • It is January and water is coming through. What you want now is a temporary fix. Nobody can judge a deck under snow, and buying a full roof in a snowstorm is how people overpay. Get it stopped, then look properly in a thaw.
  • A few granules in the gutter and a couple of curled tabs, no leak. Normal wear on an asphalt roof partway through its life. Photograph it from the ground, note the date and look again after the next hard winter.

Frequently Asked Questions

There is no roofing register here, so how do I check a roofer?

The New York State Department of State says the state does not license home improvement contractors. The Attorney General names the places that do run their own registers: New York City and Suffolk, Nassau, Westchester, Putnam and Rockland counties. Onondaga is not one of them and the county directory lists no consumer affairs office. So the checks that are left are real ones. Ask for the certificate of insurance and read the limits. General Business Law section 771-b sets a floor of one hundred thousand dollars per person and three hundred thousand per occurrence for bodily injury, fifty thousand for property damage, plus workers compensation. Then ask for the contract, because section 771-b says the insurer's name and the policy limits belong on it.

Do I need a permit to replace my roof?

It depends entirely on which of the thirty five governments in this county your address sits in. The City of Syracuse lists Roof as a residential permit type with its own application. The Village of Liverpool requires a permit for a new roof covering. The Town of Cicero and the Village of Fayetteville both say no permit is needed for a re-roof provided no more than two layers will be covered. A village address never files with the town around it. Can the new roof go over the old one?

Only sometimes, and it is the code that decides rather than the contractor. Section R908 of the Residential Code of New York State does not permit a new covering over the existing one where the roof already carries two or more applications of any type, where the existing covering is water soaked or too deteriorated to be an adequate base, or where it is slate, clay, cement or asbestos cement tile. Count the layers at a cut edge or at the eave before you take an overlay price. Two already up there means a tear-off is the only lawful answer.

Why does my roof leak at the eaves every winter and nowhere else?

Because that is where Syracuse breaks roofs. The city averages 123.8 inches of snow a year and crosses freezing in both directions on roughly 84 days, so meltwater from a warm upper slope refreezes over the cold overhang and backs standing water up under the covering. Section R905.1.2 of the Residential Code of New York State answers it with an ice barrier running from the lowest edge to a point not less than 24 inches inside the exterior wall line, and section R806 requires attic ventilation with at least one inch of clear space above the insulation at the eave. A quote that prices neither is priced short.

Will you deal with my insurance company for me?

No, and no roofer in New York may. General Business Law section 771-b subdivision 8 states that a roofing contractor shall not perform the reporting, adjusting or negotiating of a claim. Subdivision 2 also bars any offer to pay or rebate part of an insurance deductible as an inducement to sell the work. What a contractor can do is document the condition of the roof and price the repair. If your insurer gives written notice that all or part of the claim is not covered, subdivision 3 lets you cancel the contract until midnight of the third business day after that notice, and subdivision 4 gives the contractor ten days to return your deposit.

Can you give me a price over the phone?

We can tell you what drives the price on your street and what has to be in the scope, but the number that matters comes after someone has been on the roof. The median house in the City of Syracuse dates from 1948, the deck is often plank rather than plywood, and nobody knows what it is doing until the covering is off. So expect a written contract price with a stated allowance for deck repair, plus start and substantial completion dates, which is what section 771 requires anyway.
